Conviction for Herefordshire poultry keeper

Alan Ogg given a six month custodial sentence and banned from keeping poultry for life.

The 60-year-old previously residing at Lower Maescoed, pleaded not guilty to five charges under the Animal Welfare Act 2006. Mr Ogg was found guilty at Hereford Magistrates Court following trial in April, and sentenced on Tuesday 29 May 2018.

The bench ordered a 6 month custodial sentence for each offence to run concurrently with immediate effect, a life time ban and an indefinite disqualification order for owning, keeping and participating in the keeping of poultry.

Mr Ogg was found guilty of the following charges:

Failing to provide a suitable environment for a chicken, which had become trapped and could not access food or water
Failing to provide a suitable environment for 100 chickens, which had no clean bedding
Failing to provide a suitable environment of 57 chickens, which had access to poultry carcasses
Failing to provide water to 20 chickens
Failing to provide food to 92 chickens

Marc Willimont, Head of Regulatory and Development Management Services, said: “Herefordshire Council’s Trading Standards, Animal Health and Welfare service makes every effort to support Herefordshire’s rural economy; by providing advice and assisting farmers who wish to comply with the law.

“The custodial sentence reflects the severity of the evidence found in this case. The council will not tolerate animal welfare abuse in Herefordshire and we will not hesitate to take legal action.”
